Understanding IEEs

What Is an Independent Educational Evaluation?

An Independent Educational Evaluation (IEE) is a comprehensive assessment conducted by a qualified Speech-Language Pathologist who is not employed by the school district. It is requested when a parent disagrees with the results of a school district’s evaluation.

Under the Individuals with Disabilities Education Act (IDEA 2004), parents have the right to request an IEE under certain circumstances. At Virtual Speech Solutions, our IEEs are conducted with the highest clinical and legal standards.

Who Should Consider an IEE?

Is an IEE Right
for Your Child?

You may consider requesting an Independent Educational Evaluation if any of the following apply to your child or situation.

You Disagree With District Results

You disagree with the results of your child’s school district evaluation and want an independent assessment.

Areas Were Not Fully Assessed

You feel that areas of concern were overlooked or not fully evaluated during the school district’s assessment.

Child Found Ineligible

Your child was found ineligible for services, but concerns about their speech or language development remain.

Seeking a Second Opinion

You want an objective second opinion from an independent, licensed SLP not affiliated with the school district.

Eligibility Questions Remain

You need clarification regarding speech-language eligibility criteria and how they apply to your child’s profile.

Advocating for More Support

You need independent data to advocate for appropriate services and educational supports for your child.

Your Legal Rights Under IDEA

Parents’ Rights Under IDEA 2004

The Individuals with Disabilities Education Act grants parents important rights regarding educational evaluations. Understanding these rights helps you advocate effectively for your child.

You have the right to request an IEE if you disagree with the school district’s evaluation.

The district must either fund the IEE or initiate a due process hearing to show its evaluation was appropriate.

The IEE must be conducted at a location reasonably convenient to the parent and child.

Results of the IEE must be considered by the IEP team in any decision made regarding the child’s educational placement and services.

VSS provides IEEs that are fully compliant with IDEA 2004 and California Education Code requirements.

Common Questions

IEE Frequently Asked Questions

Answers to the most common questions families have when considering an Independent Educational Evaluation.

Can I request an IEE even if the district says their evaluation was appropriate?
Yes. When you request an IEE, the school district must either agree to fund the IEE or file for due process to demonstrate that its evaluation was appropriate. Until a hearing officer decides the issue, you are entitled to the IEE.
Does the school district have to follow the IEE recommendations?
The IEP team must consider the IEE findings, but is not legally required to implement every recommendation. However, independent evaluations carry significant weight in IEP discussions and can substantially influence decisions about eligibility and services.
Who pays for the IEE?
Under IDEA, if you disagree with the district’s evaluation, you may request an IEE. The district must fund the evaluation or initiate a due process hearing. In some cases, families choose to fund the evaluation privately. Contact us to discuss your specific situation.
Can VSS conduct an IEE via teletherapy?
VSS provides teletherapy-based evaluation services for families across California where in-person evaluation is not feasible. Our virtual IEEs follow the same rigorous clinical standards as in-person assessments and produce fully compliant, legally defensible reports.
How is an IEE different from a school district evaluation?
An IEE is conducted by an evaluator who has no relationship with the school district, ensuring complete independence and objectivity. VSS evaluators have no incentive to minimize or exaggerate findings. Our only obligation is to provide an accurate, comprehensive picture of your child’s communication abilities.
How long does an IEE typically take?
The evaluation itself typically takes 2 to 4 hours depending on the child’s age and the areas assessed. The full process, from intake to final report, generally takes 2 to 4 weeks. We work efficiently to ensure timelines align with your child’s IEP schedule.
What areas does a VSS speech-language IEE assess?
Depending on the referral concerns, our IEEs may assess articulation and phonology, receptive and expressive language, pragmatics and social communication, fluency, voice and resonance, and AAC needs. We tailor the evaluation to the specific areas of concern documented in the referral.
How do I get started?
Contact us using the form on this page, call (951) 223-5435, or email admin@virtualspeechsolutions.com. We offer a free initial consultation to discuss your child’s situation, explain the IEE process, and answer any questions you may have before proceeding.
